The First China Mining Law and Mining Arbitration Summit Forum Held

On September 19, the "First China Mining Rule of Law and Mining Arbitration Summit Forum" co-sponsored by China University of Geosciences (Beijing) Natural Resources Strategic Development Research Institute, Beihai Arbitration Commission, Beijing Enterprise Rule of Law and Development Research Association, and Tianjin University Law School Held in Beijing.

Zhang Hongtao, President of the Institute of Strategic Development of Natural Resources of China University of Geosciences (Beijing), attended the forum and delivered a speech.

 

Chen Yuchuan, a well-known mineral deposit geologist and academician of the Chinese Academy of Engineering, took "Discussion on Industrial Policy Issues in the Healthy Development of China's Mining Industry" as the topic, focusing on how to achieve high-quality development of China's mining industry, especially in the context of the global epidemic, how to adjust China's mining industry policy. He believes that my country's economic development is inseparable from mineral resources. Exploration should be encouraged, mining industry policies should be adjusted, and the safety of mineral resources and national economic security should be guaranteed from a strategic perspective.

Li Yuwei, former deputy chief engineer of the Ministry of Geology and Mineral Resources, delivered a speech entitled "Comparison of Chinese and Foreign Mining Taxes and Fees" on the collection of Chinese and foreign mining taxes and fees. Li Xiandong, a distinguished professor at China University of Geosciences (Beijing), analyzed the legal nature of the transfer of mining rights under the title of "Agreement on the Transfer of Mining Rights and Valuation Adjustment.

Fu Ying, former vice president of the Institute of Geology and Mineral Economics of the Ministry of Natural Resources, expressed his views on the issue of compensation for the withdrawal of mining rights in various nature reserves. Chen Congxi, a researcher at the Information Center of the Ministry of Natural Resources, gave a report entitled "Thoughts on Separate Legislation for Sand, Stone and Clay Minerals" on the skyrocketing price of sand and gravel. Bo Shaochuan, the author of "International Mining Storm", delivered a speech on "Mining Going Global and Mining Internationalization" on how to internationalize my country's mining industry. Xu Shuping, Director of the Development Office of the Oil and Gas Center of the Ministry of Natural Resources, delivered a speech on "Policy Comparison before and after the Reform of Mining Rights Management" on the reform of mining administration. Cao Xusheng, Director of the Mineral Resources Legal Affairs Department of Beijing Jingshi Law Firm, delivered a speech entitled "Proposals for the Reform of the Income System for the Transfer of Mining Rights" on the collection of proceeds from the transfer of mining rights, and released the "Conclusion Report on the Study of the Income System for the Transfer of Mining Rights in the Context of the Global Epidemic". Sun Youhai, President of the Court of Tianjin University, delivered a speech on "Establishing a Dispute Resolution Mechanism Conforming to the Characteristics of Mining" on mining arbitration matters, and Meng Lei, Associate Professor of China University of Geosciences (Beijing), delivered a speech on "Mining Arbitration Talent Training" on mining arbitration personnel training matters.

A number of experts and scholars working in the field of mining law give professional analysis of the legal problems faced by the whole process of mineral resources development from different angles.

The forum also held the establishment ceremony of the Mineral Energy Law Research Center of the Beijing Enterprise Rule of Law and Development Research Association at the same time; the opening ceremony of the "Voice of Mining Law" column of "Rule of Law Weekend" and the "Mining Law" column of "China Enterprise News" was also held at the same time.

The North Sea Arbitration Commission issued letters of appointment for mining mediation experts, members of the Mining Professional Committee and the Mining Expert Advisory Committee. Jiang Ping, a famous jurist in China and a tenured professor at China University of Political Science and Law, was employed as honorary director for life by Beihai Arbitration Commission. Pei Rongfu, a geologist of deposit geology and mineral exploration and academician of the Chinese Academy of Engineering, and Chen Yuchuan, a geologist of mineral deposits and academician of the Chinese Academy of Engineering, were respectively appointed by the Beihai Arbitration Commission as life consultants of the Mining Arbitration Expert Advisory Committee of the Beihai Arbitration Commission.

Experts at the meeting said that 2020 is an important year for China's mining reform. The Mineral Resources Act the People's Republic of China is being amended. The the People's Republic of China Resources Tax Law came into effect on September 1, 2020. In order to cooperate with the revision of the Mineral Resources Law, a series of normative documents and standards related to minerals will be implemented. At present, the global epidemic has led to a global economic recession, and the domestic economic cycle will bring new challenges to the balance of supply and demand of China's mineral resources. In the face of the decoupling of the United States, the global epidemic and the unprecedented changes in a century, it is timely to make strategic thinking on how to advance the rule of law process in China's mining industry.
